WE OFFER A FULL SUITE OF LEGAL SERVICES FOR CO-OP AND CONDO BOARDS, INCLUDING:
- General Legal Advice: We advise board members and officers on a wide variety of business and legal matters.
- Internal Corporate Documents: We prepare and review bylaws, leases, alteration agreements, house rules and transfer tax policies, among others.
- Finance: We help co-op and condo boards obtain financing and negotiate the terms of their secured and unsecured mortgage loans.
- Contracts with Third Parties: We prepare, negotiate and review construction contracts, commercial leases and license agreements (for laundry rooms, storage facilities, parking lots, advertisements, cell towers, etc.), among other types of contracts and agreements.
- Tax issues & 80/20 Rule: We have substantial experience in helping buildings keep their status as qualified cooperatives — satisfying the 80/20 rule — while realizing all of the income from their commercial leases.
- Ownership Structure/Mitchell-Lama: We help boards of Mitchell-Lama buildings evaluate the pros and cons of “going private.” Additionally, if a board decides to do so, we will create the required documents, shepherd the offering plan through the Attorney General’s office and assure a transition that is both smooth and equitable.
- Litigation: On behalf of boards, we initiate litigation against tenants or unit owners and third parties such as contractors and neighboring buildings. Additionally,we defend boards when claims are brought against the co-op or condo.
- Reducing Tax Assessments:We help boards reduce their real property tax burden by challenging tax assessments in Tax Certiorari proceedings.
- Regulatory Issues: We help co-op and condo boards comply with government regulations including those of the Environmental Protection Agency, the New York State Department of Environmental Conservation and the New York City Department of Buildings.

We also provide legal services to individuals in the purchase or sale of a cooperative or condominium unit as well as in disputes with boards.
